Aadhaar-PAN linkage: All your questions answered here

As per Income-tax Act, 1961, it is mandatory for all PAN holders, who do not fall under the exempt category, to link their PAN with Aadhaar on or before June 30, 2023.

It is the last date to link the Permanent Account Number (PAN) with Aadhaar Card. The Income Tax Department has been sharing notifications regarding the deadline on Twitter.  

The department, in a post, said, “As per Income-tax Act, 1961, it is mandatory for all PAN holders, who do not fall under the exempt category, to link their PAN with Aadhaar on or before June 30, 2023.”

According to the department, if you fail to link it, the PAN will become inoperative. 

Here are some answers to the frequently asked questions that can clear queries regarding the process and operation of the Aadhaar card and PAN linking.

Q1. Who needs to file for linking an Aadhaar card and PAN?

According to the Income Tax Act, everyone who has been allotted a PAN as on July 1, 2017, and who is eligible to obtain an Aadhaar number, he/she should have compulsorily linked their Aadhaar and PAN before the deadline.

Q2. Who is exempted from linking their Aadhaar and PAN?

Linking Aadhaar and PAN is not required for the ones who are-

Either residing in the States of Assam, Jammu & Kashmir and Meghalaya

Or a non-resident according to the Income Tax Act, of 1961,

Or the individual is of eighty years of age or even more

Q3. What is the amount of penalty for the Aadhaar and PAN linkage?

The mentioned penalty fee for failing to link the Aadhaar and PAN after the given due date is Rs 1,000. The penalty charges will be applicable from July 1.

Q4. What should be done if Aadhaar and PAN have been linked incorrectly?

In such a case, the individual needs to submit a request to the Jurisdictional Assessing Officer regarding delinking the Aadhaar from PAN. Once it’s delinked, submit the Aadhaar linking request after posting the fee payment amount, if done after the due date.

Q5. What are the consequences of not linking Aadhaar and PAN till the due date?

If an individual fails to link their Aadhaar and PAN in the given due date i.e., 30th June 2023, the PAN will be inoperative. Once the PAN is inoperative, the defaulter will also be liable to all the consequences falling under the Act.

Q6. Is it necessary to quote an Aadhaar number while filing Income Tax Return?

Yes, as per the Income Tax Act, 1961 as mentioned by the Finance Act, 2017, it is mandatory to quote the Aadhaar or the Enrolment ID of the Aadhaar form while filing for ITR.

Q7. If one has enrolled for Aadhaar but hasn’t received it, can he/she file their ITR?

Yes, he/she can mention the EID number that has been given on the Acknowledgement or the EID slip given by the enrolment centre while filing the ITR.

Q8. What is the process for NRIs to enrol for Aadhaar PAN linking in India?

The process of linking Aadhaar to PAN is only applicable to people who are eligible to have an Aadhaar number. As per the Aadhaar Act, 2016 only a resident of India is entitled to have Aadhaar.

Q9. What can possibly be done if there are any mismatches of details in the document such as name/ DOB/ gender?

The individual needs to correct their details in either of the documents to match up the details to each other. For updates on PAN, one can contact TIN-NSDL on their official website and for Aadhaar, contact UIDAI.

Paper Mode:

By filing a one-page form with minimal free with the designated PAN centre. A copy of PAN and Aadhaar is mandatory to attach.
