A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad, meanwhile, refused to stay the scheme.
The Agnipath scheme was announced on June 14 to provide for the recruitment of youths between the ages 17-and-a-half and 21, into the armed forces. The scheme allows the candidates a tenure of only four years with a provision to retain 25 per cent of them for 15 more years.
The scheme was met with severe criticism and led to protests in several states.
Later, the government extended the upper age limit to 23 years for recruitment under the scheme in 2022.
