GURUGRAM: The department of town and country planning (DTCP) has written to the Gurugram police asking it to register an FIR against 30 people, including the brother of former BJP MLA Umesh Aggarwal, for allegedly carving out an unauthorised colony and selling plots in violation of the Haryana Development and Regulation of Urban Areas Act, 1975.
In the letter to the local police on Monday, the DTCP stated that the 30 offenders must be made co-accused in an earlier FIR lodged against four persons, including the former Gurugram legislator, for developing an illegal colony, ‘Avenue 69’, on a five-acre land in Sector 69 without mandatory permission from a competent authority.
District town planner (enforcement) RS Batth said that in connivance, collusion and association with each other, the offenders were raising illegal and unauthorised construction on the said land.
The DTCP, which had issued a show-cause notice in June 2019, had noted that the reply filed by the accused was “unsatisfactory” as the latter had not produced the requisite permission obtained from a competent authority for converting the land into a colony.
The department said it has received information that the offenders were still raising illegal and unauthorised construction, in violation and contravention of ‘the provisions of the act on adjoining land’. A team of officials, it said, had visited the five-acre land in Sector 69 and during the course of their investigation found that after converting the land into an unauthorised colony, the offenders had raised another illegal and unauthorised construction over adjoining land.
The offenders sold plots to unware purchasers, and thus, conspired in the commission of the illegal act, the DTCP has maintained. Based on its investigation, Batth said, the DTCP recently wrote to Badshapur police to register an FIR against 30 persons, including the brother of Aggarwal and two property dealers.
In the previous FIR, Batth added, the department had recommended that cases should be filed against the persons and their accomplices as and when their names get associated with the offence during the investigation in the case.
As per the Haryana Development and Regulation of Urban Areas Act, 1975, no person can convert his land into a colony without the prior permission of the competent authority and no activity of any kind is permissible within the controlled/urban area in furtherance of converting a land into a colony. Also, no person, including a property dealer, can transfer plots in a colony or make an advertisement or receive any amount without obtaining a license. It further bans the erection of any building other than for purposes of agriculture, which includes horticulture, dairy farming, poultry farming and planting and upkeep of an orchard.
