Gurgaon: Two relatives of former Gurgaon MLA Umesh Aggarwal and the husband of current MCG councillor Sheetal Bagri are among 22 people who have been served showcause notices by the DTCP for allegedly constructing 130 flats in violation of the Haryana Development and Regulation of Urban Areas Act.
The alleged offenders have been directed to submit their replies by August 13, failing which FIRs could be lodged against them and the DTCP would pass restoration orders.
This is the second such clampdown on an illegal colony after Ansal Esencia Extension in Sector 67, where 150 flats were constructed without any approval. Former councillor Gaje Singh Kablana, the husband of senior deputy mayor Pramila Kablana, and 20 others were booked for the violation.
District town planner (enforcement) RS Batth said on Monday that they received a social media post alleging that an unauthorised colony had come up in New Colony of old Gurgaon. It said that the developers had divided the land into small plots, constructed flats and then sold both houses and plots in violation of the Act.
“A team inspected the site and found the allegations true. After the revenue documents were scanned, it was found that the accused had carved out an illegal colony on land that belongs to the revenue estate of Gurgaon village. They hadn’t taken any permission from the competent authority before starting construction and selling the houses and flats to people. The sale deeds were executed in their favour,” said Batth.
The colony has been built across 4,500 square yards. The land originally belonged to Dev Samaj Trust, but was later sold to Indo-UK E-services Company. Hitesh and Rakesh Aggarwal, who are related to former MLA Umesh Aggarwal, were among those who had sold the trust land and allowed the colony to come up there. Manish Kumar, another accused, was actively involved in getting deeds executed on behalf of the company.
Batth said they were investigating how the trust land was sold to a private party.
The showcause notices were issued on the directions of DTCP director KM Pandurang. “If they fail to furnish satisfactory replies, the department will issue restoration orders and get FIRs registered against them. We have already sent a report to the director’s office to initiate a demolition drive,” said Batth.
Sources said the role of MCG officials is also being questioned for failing to take action against the developers of the illegal colony, which was constructed in 2015. Tehsildars and officials of DHBVN are also under the scanner for getting the registries done without the mandatory no objection certificates from DTCP and approving electricity connections.
In the case of Ansal Esencia Extension, around 150 illegal flats on 1.5 acres were built adjacent to Ansal Esencia, an approved project in Sector 67. The project was named Ansal Esencia Extension to mislead the homebuyers.
